End User License Agreement (EULA)

This End User License Agreement (hereinafter this "Agreement") is an agreement between you and YUCTS (櫻佑旅遊) (hereinafter the "Service" or "we") concerning the use of the iOS/iPadOS/macOS applications published by the operator of the Service—including the Yucts Travel App (iOS/iPadOS/macOS) and the YucDu App (each hereinafter an "App"). By downloading, installing, or using an App, you agree to this Agreement, the Terms of Service, and the Privacy Policy.

The Apps offer different features: the Yucts Travel App includes accounts, the forum, the AI assistant, advertising, and the Yucts Plus subscription; the YucDu App, by contrast, is a read-only blog reader with no account, User Content, advertising, or in-app purchases. The provisions of this Agreement that relate only to a specific feature apply only to the App to which that feature applies.

Relationship with Apple's Standard License Agreement

The App is distributed through the Apple App Store. In addition to this Agreement, Apple's Licensed Application End User License Agreement also applies to your use of the App. If this Agreement conflicts with Apple's standard agreement, Apple's standard agreement shall prevail to the extent of the conflict.

1. Scope of License​

Provided that you comply with this Agreement, we grant you a non-exclusive, non-transferable, revocable license to use the App solely for personal, non-commercial purposes on an Apple device that you own or control and that complies with Apple's usage rules.

2. Use Restrictions​

You may not:

  • Reproduce, distribute, rent, sell, sublicense, or otherwise transfer the App;
  • Reverse engineer, decompile, disassemble, or attempt to obtain the source code of the App (except where expressly permitted by law);
  • Modify or adapt the App, or remove any proprietary notices therein;
  • Circumvent, disable, or interfere with the App's security, authentication, or billing mechanisms;
  • Use the App for any unlawful purpose or in any manner that violates this Agreement.

3. Accounts and User Content​

The rules governing the App's accounts, login, and User-Generated Content (UGC) are handled in accordance with the Terms of Service, including the community guidelines, content license, and reporting and moderation mechanisms. (The YucDu App is a read-only reader with no account or User Content features, and this section does not apply to that App.)

4. Subscriptions and In-App Purchases (Yucts Plus)​

The Yucts Travel App offers the "Yucts Plus" paid subscription and one-time purchases, all billed through the Apple App Store. For an explanation of auto-renewal, cancellation, refunds, and restoring purchases, see Section 6 of the Terms of Service. (The YucDu App is a free App with no subscriptions or in-app purchases of any kind.)

5. Third-Party Services and Advertising​

The App integrates with or links to third-party services (such as Apple, Google AdMob, AI service providers, and maps and weather services) and may display advertising. These third parties have their own terms and privacy policies. For an explanation of data processing and advertising tracking, see the Privacy Policy. (The YucDu App displays no advertising and does not integrate any advertising services.)

6. Intellectual Property​

The App and all related intellectual property rights belong to the operator of the Service or its licensors. This Agreement does not transfer any rights to you; all rights outside the scope of the license are reserved.

7. Updates​

We may from time to time provide updates, patches, or new versions to maintain and improve the App, and such updates are also governed by this Agreement.

8. Termination​

If you violate any term of this Agreement, this license will automatically terminate. Upon termination, you shall stop using and delete the App. Sections 2, 6, 9, 10, and 12 shall survive termination.

9. Disclaimer​

The App is provided on an "as is" basis. To the maximum extent permitted by law, we make no express or implied warranty, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability​

To the maximum extent permitted by law, we are not liable for any damages arising from the use of or inability to use the App. This disclaimer does not affect liability that cannot be excluded under mandatory law.

You and we agree that:

  • This Agreement is concluded solely between you and the Service, and not with Apple; the App and its content are the responsibility of the Service (and not Apple).
  • Apple has no obligation whatsoever to provide maintenance or support for the App.
  • To the extent permitted by law, Apple bears no product warranty responsibility for the App; any warranty claim shall be handled by the Service.
  • For any claim you raise regarding the App (such as product liability, non-compliance with law, or consumer protection), the Service (and not Apple) is responsible in accordance with this Agreement and applicable law.
  • If a third party claims that the App, or your possession and use of the App, infringes its intellectual property rights, the Service (and not Apple) is responsible for the investigation, defense, and handling thereof.
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple has the right to enforce this Agreement against you as a third-party beneficiary.
  • You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated as a "terrorist supporting" country, and that you are not on any U.S. Government prohibited or restricted list.

12. Governing Law​

This Agreement is governed by the laws of the Republic of China (Taiwan) (except where Apple's standard agreement provides otherwise, in which case its provisions shall apply to that extent).
